Be kinda nice to know what they’re suing for; the article doesn’t say. Medical expenses? Those should be covered under the RAGBRAI group insurance that all registered riders get as part of their registration fees. Damages to the bike? Ditto, although I also thought registered riders did have to sign a liability waiver and release. A refund of the unused portion of their RAGBRAI fee? A lot of time and hassle for what would maybe amount to 150 bucks. Pain and suffering? See the waiver comment; besides which, it’s kinda hard to put an accurate dollar figure on something like that.
Or did they find some low-life bottom-feeding attorney who convinced them that this was their chance to hit the lottery and is bringing this suit against anybody who’s got a dog in this fight on a contingency basis — which means the legal beagle also stands to make out (usually they get at least a third of any award or settlement) if anything comes of this, either in a trial or through a settlement.

First, there is no insurance coverage through RAGBRAI any more. Unless they’ve reinstated it in the last couple of years it was discontinued about 5 years back. I find it funny that they didn’t announce you no longer had insurance, you just had to find out if you needed that coverage.
As to the waiver, that’s fine except in the obvious case of neglect which in the case of the cart driver, it obviously was.
I’m not saying they should or shouldn’t sue (I probably wouldn’t) but in any case there is negligence here that could result in a settlement.
And no, I’m not a lawyer and haven’t ever played one on tv.

I’m thinking Ragbrai covers ambulance service on the bike route and/or transportation to the closest ER, if need be. From there your insurance picks it up.

My sister-in-law broke her arm a couple of years ago in an accident on RAGBRAI. There was no insurance from RAGBRAI to cover anything – ambulance ride or medical expenses. Her personal insurance covered it.

Article should say what they’re suing for, but the allegation that it was a golf cart operated by someone officially associated with Regbrai makes some difference. If I crash on a ride organized by Joe Blow it’s my problem. If Joe Blow runs me down with his car during the ride it’s his problem.

Indanafrank is right. Signing the waiver doesn’t mean that Ragbrai still can’t be sued and lose – because there is always the possibility that they ARE in fact liable for an injury or death. Of course, that’s what the lawsuit would help determine.
Lawsuits can also arise if a person feels another person on the ride was unsafe or malicious somehow in their riding. It has to be proven, witnesses must be found, etc. – but lawsuits can be brought to bear on people who cause accidents on Ragbrai.
